Jewish Lawyer Held for Nearly 10 Hours After Police Question Star of David Pendant at Pro-Palestine Protest

A Jewish man was detained by police for nearly 10 hours after officers arrested him at a pro-Palestine demonstration and questioned whether his Star of David pendant could cause offence to protesters.

The lawyer, whose identity remains protected due to security concerns, was arrested outside the Israeli embassy in Kensington on 29 August at 7pm and not released until 4.30am the following morning.

Police interview recordings reveal that detectives interrogated him about the religious symbol he wore on a silver chain, raising alarm about the treatment of Jewish people expressing their faith in public.

Officers Question Religious Symbol as “Antagonising”

The Star of David pendant, measuring less than an inch across, prompted a detective constable from the robbery unit to question the arrested man about his “political beliefs” during the lengthy detention.

What necklace are you wearing?” the officer asked, according to recordings of the police interview obtained by The Telegraph.

The detective claimed that police had received reports the Star of David was “antagonising” protesters at the demonstration, despite the event being organised by the International Jewish Anti-Zionist Network (IJAN), a group that opposes Zionism whilst maintaining Jewish religious identity.

The officer, who mistakenly referred to the organisation as the “International Jewish Solidarity Network,” argued they were dealing with “a very niche environment where tensions are high” rather than someone “walking about with a Star of David chain on his neck in an open forum in public generally”.

Solicitor Objects to Religious Questioning

The arrested man’s solicitor interrupted the police questioning, expressing serious concern about officers “raising my client’s religion and wearing a sign in relation to that”.

The intervention highlights the extraordinary nature of police interrogating a Jewish man about wearing a religious symbol that has been central to Jewish identity for thousands of years.

The Star of David, known in Hebrew as the Magen David or Shield of David, is one of the most recognisable symbols of Judaism and appears on synagogues, Jewish religious texts, and the flag of Israel.

Questioning whether its display constitutes a provocation raises profound concerns about religious freedom and whether British Jews can safely express their faith in public spaces without facing arrest.

Arrested Man Condemns “Criminalisation” of Jewish Symbol

Speaking to The Telegraph, the detained lawyer condemned his treatment by police and accused them of attempting to criminalise the wearing of Jewish religious symbols.

“They are trying to criminalise the wearing of a Star of David. They said I was antagonising and agitating pro-Palestine protesters with my Star of David,” he said.

The accusation that simply wearing a religious symbol constitutes antagonism towards political protesters represents a troubling precedent for religious freedom in Britain.

The arrest occurred at a demonstration organised by a Jewish group that opposes Israeli government policy, making the claim that a Star of David would antagonise attendees particularly peculiar.

Ten-Hour Detention Raises Serious Questions

The length of the detention, spanning nearly 10 hours from 7pm until 4.30am, raises questions about the proportionality of police action and whether the arrest was justified.

During this extended period, the Jewish man was held in custody, questioned about his religious beliefs and symbols, and prevented from returning home until the early hours of the morning.

No information has been disclosed about whether charges were brought against him or the legal basis for his arrest and prolonged detention.

The involvement of a detective constable from the robbery unit in questioning someone about wearing religious jewellery at a political demonstration also appears unusual, given that robbery detectives typically investigate theft and property crimes.

Context of Rising Tensions Over Israel-Gaza Conflict

The arrest took place against the backdrop of heightened tensions surrounding the ongoing Israel-Gaza conflict, which has sparked numerous demonstrations across Britain since October 2023.

Pro-Palestine protests have become regular occurrences in London, with thousands gathering to call for ceasefires, condemn Israeli military action, and express solidarity with Palestinians.

These demonstrations have occasionally been accompanied by reports of antisemitic incidents, with Jewish community organisations documenting increased hostility towards British Jews amid the Middle East conflict.

However, the International Jewish Anti-Zionist Network, which organised the protest where this arrest occurred, represents Jews who oppose Israeli government policies whilst maintaining their Jewish religious and cultural identity.

Religious Freedom and Public Order Concerns

The case raises fundamental questions about the balance between maintaining public order at politically charged demonstrations and protecting the religious freedom of individuals to display symbols of their faith.

British law protects freedom of religion and expression under the Human Rights Act 1998, which incorporates the European Convention on Human Rights into domestic legislation.

Article 9 of the Convention guarantees the right to freedom of thought, conscience and religion, including the right to manifest one’s religion through worship, teaching, practice and observance.

Any restriction on this right must be prescribed by law and necessary in a democratic society for purposes including public safety or the protection of the rights and freedoms of others.

Precedent for Policing Religious Symbols

The arrest echoes previous controversies over how British police handle religious and political symbols at demonstrations.

In recent years, police have faced criticism from multiple directions, accused by some of being too heavy-handed with certain protesters whilst being too lenient with others.

The question of whether displaying a Star of David constitutes a provocation at a pro-Palestine demonstration organised by an anti-Zionist Jewish group appears particularly fraught.

If police determine that wearing Jewish religious symbols at political protests constitutes antagonism warranting arrest, it could have severe implications for Jewish participation in public life and political discourse.

Community Response and Political Implications

Jewish community organisations and civil liberties groups are likely to view the arrest with alarm, seeing it as evidence that British Jews cannot safely express their religious identity in public without facing state intervention.

The incident comes as Jewish communities across Europe report increased anxiety about antisemitism and their ability to live openly as Jews amid polarised debates about the Israeli-Palestinian conflict.

Politicians across the political spectrum have repeatedly emphasised that British Jews should not be held responsible for the actions of the Israeli government and that antisemitism has no place in legitimate criticism of Israeli policy.

However, this arrest suggests that some police officers may be treating the display of Jewish religious symbols as inherently provocative in contexts involving criticism of Israel, collapsing the distinction between Jewish identity and Israeli government policy.

The Metropolitan Police has not publicly commented on the arrest or explained the legal justification for detaining a man for wearing a religious symbol at a demonstration organised by a Jewish group.

As debate continues over how to balance freedom of expression, religious liberty, and public order at politically charged demonstrations, this case is likely to fuel concerns about whether British Jews can safely express their identity in public spaces.
