A migrant who raped a 15-year-old girl after arriving in the UK on a small boat tried to blame “cultural differences” for his horrific attack – before exploding in rage when jailed for 12 years.
Sadeq Nikzad, 29, pounced on the terrified teen in broad daylight after stalking her through Falkirk town centre and luring her to the back of a pub in October 2023 – just two years after arriving in Britain as an illegal immigrant from Afghanistan, according to The Sun.
In an extraordinary defence that has sparked outrage, his lawyer Janice Green reportedly claimed the fiend had not been educated about the “significant cultural differences” between the UK and Afghanistan, where child marriage is common.
SICKENING DEFENCE
The defence lawyer tried to argue that the language barrier between Nikzad and his victim, combined with the fact she did not say “no”, meant it was “not a typical stranger rape”, The Sun reported.
Green reportedly told the court: “I’m not suggesting that means that he reasonably believed (the victim) was consenting, but that there’s a reason why he could have misunderstood.
COURTROOM CHAOS
When Judge Morris handed down the 12-year sentence at Livingston High Court, Nikzad erupted in fury, according to The Sun’s report.
The convicted rapist:
- Branded the judge a “liar”
- Had to be handcuffed by security
- Began screaming and gesticulating wildly in the dock
- Refused to accept he had done anything wrong

Official court records confirm that on October 16, 2023, Nikzad spotted the schoolgirl walking through Falkirk town centre and began his predatory pursuit.
The Crown Office and Police Scotland confirmed he:
- Repeatedly pestered her for her phone number
- Made sexual remarks to the terrified teen
- Led her into a courtyard where he subjected her to a serious sexual assault

According to The Sun, the traumatised girl later said she froze during the attack and was “quite shocked.
A passer-by who found the teen reportedly said: “She looked stunned. I knew something had gone wrong. She came to me for comfort. She said she kept telling the guy she was only 15.”
JUDGE’S DAMNING VERDICT
Passing sentence through an interpreter, Judge Morris told Nikzad: “I appreciate that you don’t accept that you’ve done anything wrong, but the fact remains that you’ve been convicted of an extremely serious sexual offence against a child.
“I know your counsel has now explained to you that in those circumstances only a substantial custodial sentence is appropriate.”
ILLEGAL ENTRY
The Sun reported that Nikzad had entered the UK illegally two years before the attack, arriving on a small boat from Afghanistan.

Police Scotland confirmed that local officers ensured Nikzad was “identified, arrested and off the street within a few short hours following the incident.
Detective Inspector Forbes Wilson, from the Forth Valley Public Protection Unit, said: “This was a particularly harrowing attack which was carried out during daylight in a busy town centre.
Nikzad’s heinous actions had a profound effect on his young victim and I would like to commend her strength throughout this ordeal.
HARSH SENTENCE
The court imposed:
- 12-year extended sentence – comprising nine years in custody and three years supervision
- Sex offenders register – indefinitely
- Non-harassment order – banned from contacting victim indefinitely
- DEPORTATION – will be removed from UK at end of sentence

Katrina Parkes, Procurator Fiscal for High Court Sexual Offences, said: “This was an appalling, opportunistic attack on a young girl who should have been safe going about her daily business.
The victim should be commended for reporting Sadeq Nikzad to the police, ensuring that he has now been held accountable while also protecting others from harm.
This type of offending will not be tolerated, and I hope this prosecution sends a clear message to men who commit serious acts of sexual violence against women and children.
AFGHANISTAN’S CHILD MARRIAGE CRISIS
While Nikzad’s lawyer reportedly cited cultural differences as a factor, the reality is that Afghanistan has one of the highest rates of child marriage in the world:
- Up to 57% of Afghan girls are married before age 19
- The most common ages for marriage are 15 and 16
- Afghan law technically sets the minimum age at 16 for girls
However, UK law is crystal clear – sex with anyone under 16 is statutory rape, regardless of claimed consent or cultural background.
