Justice Department Pardon Attorney Ed Martin confirmed Monday he has been directed to investigate whether Biden “was competent and whether others were taking advantage of him through use of AutoPen or other means” – as Republicans demand answers about who was really running the country.

House Oversight Committee Chairman James Comer dropped a stunning revelation: “There was more activity [using the autopen] in the last 100 days of the Biden administration than the first three and a half years of the Biden administration.
‘They have all lawyered up’
In an ominous sign of the scandal’s seriousness, Comer revealed that four key Biden staffers have already retained legal counsel as investigators close in.
“The four staffers that we’ve asked to come in for transcribed interviews, they have all lawyered up,” Comer told Hannity. “They are taking this very seriously, and this is going to be a battle to get to the truth.”
The Kentucky Republican has vowed to subpoena former Biden aides:
- Annie Tomasini – Biden’s White House trip director
- Anthony Bernal – First Lady Jill Biden’s top adviser
- Ashley Williams – Deputy White House chief of staff

“Who was operating the autopen? This is a very serious thing,” Trump told reporters ahead of a meeting with House Republicans. We had a president that didn’t sign anything. He autopenned almost anything.”
The President went further, claiming “radical left lunatics” who were running the country used the device after being frustrated that Biden, not Bernie Sanders, won the Democratic nomination.
“They said, ‘Wait a minute, this is a gift. He’ll do anything. We’re going to use the autopen,'” Trump said. “And they used the autopen on everything.”
The January 19 pardon frenzy
Investigators are zeroing in on a flurry of last-minute pardons issued on January 19 – Biden’s final full day in office – including:

- General Mark Milley

Trump escalated his attacks over the weekend, calling the autopen scandal a “major part of the real crime, THAT THE PRESIDENTIAL ELECTION OF 2020 WAS RIGGED AND STOLEN!
Whoever had control of the ‘AUTOPEN’ is looking to be a bigger and bigger scandal by the moment,” Trump posted on Truth Social, adding that the January 6 committee members who received pardons “DELETED AND DESTROYED ALL EVIDENCE.

While autopens have been used by presidents for decades – with Barack Obama being the first to sign legislation with one – legal experts say the key issue is whether Biden authorized their use.
